ARE YOU BREAKING THE LAW?

Employers register with SARS and submit their EMP201. They do not however update their details with the Department of Labour. For employers with a stable workforce this is an irregular requirement which often gets overlooked.

The Unemployment Insurance Act requires that ALL employers submit a register of changes to their employee details before the 7th of each month. Failure to do so is a contravention of the UIF act and is liable to a fine or to imprisonment, or to both a fine and imprisonment. (s65).

Employers who do not update employee information will hinder their employees' claims from the UIF as their employment and contribution data must first be verified, resulting in significant delays with the payment of benefits.

To register your employees with the UIF, form UI-19 must be completed for all employees and submitted. Any changes to employee information must be advised on the same form on a monthly basis.
